About these terms

These terms govern your use of weforge.africa and every page on it. They also hold forge's legal disclosure — who we are, where we can be found and where legal documents are served on us — so that there is one place to look for it.

By using this site you agree to these terms. If you do not agree, please do not use the site.

Who is who

  • forge, we, us and our mean the person or entity named under Who we are below, trading as forge.
  • You means anyone who visits or uses the site, and, where you use it on behalf of an organisation, that organisation too.
  • The site means weforge.africa and all its pages, text, images, video, design and code.
  • An engagement agreement means a written agreement, signed by forge and a client, under which forge actually does work.

Effective date

These terms are effective from TO BE SUPPLIED — date published.

Changes to these terms

We may change these terms from time to time by publishing a new version on this page, with a new effective date. The version on this page when you use the site is the one that applies to that use. Changes do not reach back: anything that happened before a change is governed by the terms in force at the time.

The rest of our legal pages

These terms sit alongside three other pages, each of which is the single home for its subject:

  • Privacy — how we handle personal information, under the Protection of Personal Information Act 4 of 2013.
  • Cookies — what this site does, and does not, store on your device.
  • PAIA — our Information Officer, and how to request access to records under the Promotion of Access to Information Act 2 of 2000.

Who we are

This is forge's disclosure under section 43(1) of the Electronic Communications and Transactions Act 25 of 2002 (ECTA). Much of section 43 applies only to a site that sells goods or services by electronic transaction, and this site sells nothing. We give the disclosure anyway — the parts of section 43(1) that apply to a site that sells nothing online — because you should know exactly who you are dealing with.

Address for service of legal documents

forge chooses the following physical address as its domicilium citandi et executandi — the address at which it will accept service of all legal process and formal notices:

TO BE SUPPLIED — physical address for service of legal documents (domicilium citandi et executandi)

Legal process, and any notice that has legal effect, is validly served on forge only by delivery to that address. Service by email, WhatsApp, social media, or any other electronic means is not valid service on forge unless forge has agreed to it in writing, in that particular case. We may change this address by publishing a new one on this page; the new address takes effect from the date it is published.

What this site is, and what it is not

This site tells you about forge and the work we do. It is general information, offered so that you can decide whether to talk to us. It is nothing more than that.

Nothing here is an offer

Nothing on this site is an offer capable of acceptance. Descriptions of our services, approaches, deliverables, timeframes or ways of working are an invitation to start a conversation — in legal terms, an invitation to treat. No contract comes into being because you read a page, contact us, or tell us you would like to go ahead.

This site sells nothing. You cannot buy, order, book or pay for anything on it. No transaction is concluded through it, so the provisions of Chapter VII of ECTA that govern electronic sales to consumers, including the cooling-off right in section 44, are not engaged by your use of the site.

Work happens under a signed agreement

forge does work only under a written engagement agreement signed by forge and the client. That agreement alone sets out what we will do, for whom, at what price, on what timetable and on what terms — including who delivers each part, where forge works with partner companies in its collective.

If an engagement agreement says something different from this site, the engagement agreement prevails. Nothing on this site adds to, varies or is incorporated into an engagement agreement unless the agreement expressly says so.

General information, not advice

The content on this site is general. It is not tailored to you, your organisation, your data or your circumstances, and it is not professional, technical, financial, legal or any other kind of advice.

Do not act, or decide not to act, on the strength of this site alone. Before relying on anything here, speak to us — or to another suitably qualified adviser — about your particular situation.

Reading the site, or contacting us through it, does not create a client, adviser, fiduciary or any other professional relationship between you and forge. That relationship begins only when an engagement agreement is signed.

Descriptions, examples and artificial intelligence

  • Descriptions of what our services can achieve are not promises of outcome. Results depend on your organisation, your people, your data and many things outside our control.
  • Artificial intelligence in particular produces probabilistic output. Where this site describes augmented-intelligence work, it describes what such systems are designed to do, not a guarantee of what they will do in your setting. How AI is designed, tested, supervised and relied upon in a given engagement is set out in that engagement's agreement.
  • Examples, scenarios and figures on this site are illustrative. They show the kind of work we do. Unless a page says expressly that it describes a named, real engagement, you should not read it as a record of one or as a forecast of your results.
04

Using the site

You are welcome to read, browse and share this site. What follows keeps it working, and keeps it ours.

Acceptable use

You may use the site only lawfully and only for its intended purpose: learning about forge. You must not, and must not help or allow anyone else to:

  1. scrape or harvest — use any robot, spider, crawler, scraper or other automated means to copy, index, extract or collect the site's content, or any contact details, personal information or other data from it. This does not stop public search engines from indexing the site in line with its robots.txt file;
  2. use the content to train or build other systems — copy the site's text, images, video, design or code into any dataset, model, or artificial-intelligence system without our prior written consent;
  3. interfere — do anything that disrupts, damages, overloads or impairs the site or the servers and networks it runs on, including denial-of-service attacks and the introduction of viruses, malware or other harmful code;
  4. break in — gain, or try to gain, unauthorised access to the site, its hosting, or any system or data connected to it, or probe, scan or test their vulnerability;
  5. circumvent or copy — circumvent any security or access control, or copy the site's design or code for use on another site. Viewing the site's source in your browser is fine;
  6. frame or mirror — display the site, or any part of it, inside a frame, or reproduce it on another site, so as to alter its appearance or suggest it belongs to someone else;
  7. impersonate or mislead — present yourself as forge, suggest a connection with or endorsement by forge that does not exist, or use the site to deceive anyone;
  8. break the law — use the site in any way that breaches any law, or the rights of any person.

Unauthorised access to, interception of, or interference with data, computer programs and computer systems is a crime in South Africa, under the Cybercrimes Act 19 of 2020 and the provisions of Chapter XIII of ECTA that remain in force. We reserve the right to report misuse to the South African Police Service and any other competent authority, and to pursue every civil remedy open to us.

Availability

We aim to keep the site available and working, but we do not promise that the site will be available at any particular time, uninterrupted, secure, or free of errors, viruses or other harmful components. We may change, suspend or withdraw the site, or any part of it, at any time and without notice. Protecting your own devices and data while you browse is your responsibility.

Linking to this site

You may link to any page of this site, provided you do so fairly and lawfully, do not damage our reputation or take advantage of it, and do not suggest any association, approval or endorsement that does not exist. You may not frame the site, or link to it from a site that is unlawful, or whose content is misleading or offensive. We may withdraw this permission for any particular link by telling the person responsible.

Links from this site

Some pages link to sites we do not control — for instance, the photographers, type designers and other creators credited in the footer. Those links are there for your convenience and to credit other people's work. We are not responsible for the content, availability, security or privacy practices of any site we link to, and a link is not an endorsement. Your use of another site is governed by that site's own terms.

Intellectual property

What belongs to forge

The site and everything on it that forge created — its text, structure, design, layout, graphics, illustrations, video edits and code — is protected by copyright under the Copyright Act 98 of 1978 and by international treaty, and belongs to forge or is used by forge with permission.

The name forge, our logo and the names we use for our services are trading names and get-up in which forge claims the rights the law gives it, including under the common law of passing off. No one may use them in a way likely to suggest a connection with forge. Nothing on this site grants you any right to use them. You may use the name forge in plain text to refer to us accurately.

© 2026 TO BE SUPPLIED — full legal name of the copyright holder. All rights not expressly granted in these terms are reserved.

What you may do

We grant you a limited, personal, non-exclusive, non-transferable and revocable licence to:

  • view the site in a web browser;
  • print or save a reasonable number of pages for your own reference, or for internal discussion within your organisation about working with forge;
  • quote short extracts, with a clear credit to forge and a link to the page quoted.

You must leave every copyright and other notice intact. Any other copying, reproduction, adaptation, publication, distribution or commercial use of the site's content requires our prior written consent. The licence ends automatically if you breach these terms.

What belongs to others

Some photographs, video and typefaces on this site are the work of other people and are used under their providers' licences, including those of Unsplash and Pixabay. Their creators are credited in the site's footer. That material remains the property of its owners, and nothing in these terms grants you any right to it. If you want to use it, obtain it from its source under that source's own licence.

If you believe we have used your work wrongly

If you believe something on this site infringes your rights, tell us through our contact page, identifying the material and your rights in it. We will look into it promptly and, where the complaint is well founded, remove or correct the material.

06

Communicating with us

You can reach us by email or WhatsApp, using the details on our contact page. Emails and messages are data messages under ECTA. The rules in Part 2 of Chapter III of ECTA (sections 21 to 26) on when and where a data message is sent and received apply only where the parties have not agreed otherwise — and by using the site and writing to us, you agree to what follows.

When a message reaches us

  • A data message sent to forge is received only when it has actually come to the attention of the person you wrote to at forge — not merely when it arrives on a server or device. Where it matters that we have received something, ask us to confirm, and treat it as received only once we reply confirming it. This rule does not apply to a request or notice made under the Promotion of Access to Information Act, the Protection of Personal Information Act or any other law that fixes when such a request or notice is received.
  • An automatic reply, a delivery or read receipt, or an acknowledgement that a message has arrived, is not an acceptance of anything in it, and does not bind forge to anything.
  • A data message from forge is received by you when it enters an information system you have used to communicate with us and can be retrieved and read by you.

No contract by message

No agreement with forge — and no variation of one — comes into being through an email, a WhatsApp message, a voice note or a conversation. Agreements with forge are concluded only by a written engagement agreement signed by forge. A message discussing scope, prices or dates is part of a negotiation, not a binding commitment.

Legal notices

Legal process and formal notices must be served at the address for service under Who we are above. Electronic notices are not valid service on forge unless forge has agreed to them in writing in that particular case.

Please do not send us confidential information unasked

Please do not send us confidential, commercially sensitive or personal information about anyone else until we have agreed with you, in writing, how it will be protected. Where an engagement calls for it, we are glad to sign a confidentiality agreement before you share anything.

Unless and until such an agreement is signed:

  • no duty of confidence, and no fiduciary relationship, arises from information you send us unasked;
  • information you choose to send us is not treated as confidential by forge, although any personal information in it is always handled as our privacy page describes.

Unsolicited ideas

If you send us ideas, suggestions, proposals, designs or other material we did not ask for, forge is under no obligation in respect of them — not to review them, keep them confidential, return them, credit you or pay you for them. forge may already be working on, or may later independently develop, something similar. You agree that forge remains free to develop, use and offer anything it creates, whether or not it resembles what you sent, and that sending us unsolicited material does not create any claim against forge.

07

Our responsibility, and yours

Please read this section carefully. We draw your attention to this section because it limits our liability and places risk on you — whether or not the Consumer Protection Act 68 of 2008 applies to your use of the site.

The site is provided as it is

We take care over what we publish, but the site is general information, provided free of charge. To the fullest extent the law allows, the site and its content are provided "as is" and "as available", without any warranty, representation or guarantee — express or implied — that the content is accurate, complete, current, or fit for any particular purpose. We may correct, update or remove content at any time, and are under no obligation to keep it current.

Limitation of liability

To the fullest extent permitted by South African law, forge — and its owners, directors, employees, partner companies and contractors — will not be liable to you for any loss or damage of any kind arising from, or connected with:

  • your use of the site, or your inability to use it;
  • your reliance on any content on the site;
  • any error in, or omission from, the site;
  • any interruption, delay, virus or other harmful component affecting the site or reaching you through it;
  • any site we link to, or any third-party material shown on the site;
  • any unauthorised access to, or alteration of, anything you send us, where that happens despite our reasonable care.

This includes direct, indirect, special and consequential loss, and loss of profit, revenue, data, business, opportunity or goodwill, however it arises — in contract, delict or otherwise — even if we were told that such loss was possible.

What this section never excludes

Nothing in these terms:

  • limits or excludes forge's liability for loss caused by its gross negligence, wilful misconduct or fraud, or for death or personal injury caused by its negligence;
  • limits or excludes any liability that cannot lawfully be limited or excluded, or deprives you of any right you have under the Consumer Protection Act or any other law that cannot lawfully be waived.

Where a law applies that restricts how far liability may be limited, forge's liability is limited to the fullest extent that law permits.

Your indemnity to forge

You indemnify forge — and its owners, directors, employees, partner companies and contractors — against loss, damage and liability that any of them suffers or incurs because of your unlawful use of the site or your wilful breach of these terms, together with legal costs as a court orders.

This indemnity covers only loss that flows from your own unlawful use or wilful breach. It does not make you responsible for anything forge itself caused.

08

General

Governing law

These terms, and any dispute or claim arising from or connected with them or with the site — whether in contract, delict or otherwise — are governed by the law of the Republic of South Africa.

Jurisdiction

You and forge each consent to the jurisdiction of the High Court of South Africa, KwaZulu-Natal Local Division, Durban, in any dispute arising from these terms or the site.

Under section 45 of the Magistrates' Courts Act 32 of 1944, you and forge also each consent to the jurisdiction of any magistrates' court that has jurisdiction over the person being sued, even where the amount in dispute would otherwise be beyond that court's jurisdiction. forge may choose to bring proceedings in such a court.

Nothing in this clause takes away any right you have, as a consumer, to bring a complaint before a forum the Consumer Protection Act makes available to you.

If part of these terms fails

Each provision of these terms is separate. If a court finds any provision, or part of one, invalid, unlawful or unenforceable, that provision is read down to the extent needed to make it enforceable — or, where that cannot be done, severed — and the rest of these terms continue in full force.

No waiver

If forge does not enforce a right under these terms, or delays in doing so, or allows you extra time or other latitude, that is not a waiver of the right and does not stop forge from enforcing it later. A waiver binds forge only if it is in writing and signed by forge.

Whole terms

These terms are the whole agreement between you and forge about your use of the site. The privacy, cookies and PAIA pages are notices, given for your information and to meet forge's statutory duties; they are not terms of this agreement and create no contractual obligations. These terms do not govern any work forge does: that is governed only by the engagement agreement for that work, which prevails over these terms.

Transfer

forge may transfer its rights and obligations under these terms to any successor to its business, including a company forge incorporates to carry on the business now traded as forge. You may not transfer yours.

Headings

Headings in these terms are for convenience only, and do not affect how the terms are read.
